Terms of Service
Effective date: September 10, 2026
These Terms of Service ("Terms") govern your use of foundworks.app (the "Site"), operated by Foundworks ("we," "us"). By using the Site, you agree to these Terms.
1. Use of the Site
The Site describes Foundworks' web design services for informational purposes. Specific client engagements are governed by a separate, signed service agreement, which controls over anything on this Site in the event of a conflict.
2. No guaranteed results
Foundworks does not guarantee specific business outcomes, including traffic, leads, conversions, or search rankings, from any service. Results vary by business, market, and factors outside our control.
3. Intellectual property and AI-assisted content
Content on this Site is owned by Foundworks or its licensors unless noted. Some content or deliverables may be created or assisted by artificial intelligence tools. Under current U.S. Copyright Office guidance, purely AI-generated material may not be eligible for copyright protection absent sufficient human authorship. Ownership of client deliverables is defined in each client's individual service agreement, not by this Site.
4. Testimonials and reviews
Any testimonials or client statements displayed on this Site are genuine, attributable to real clients, and used with permission. We do not fabricate testimonials. Concept designs shown on the Site are the studio's own work and are clearly labeled as concepts, not client projects.
5. Disclaimer of warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
6. Limitation of liability
To the fullest extent permitted by law, Foundworks and its founders shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Site.
7. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts in Orange County, California.
8. Changes
We may update these Terms. Continued use of the Site after changes constitutes acceptance.
